I.
Introductory provisions

  1. In this document (“Regulations”), Cyklo 69 s.r.o., company identification number: 282 05 081, tax identification number: CZ28205081, with its registered office in Prague 6, Bubeneč, Rooseveltova 892/49, postal code: 160 00, entered in the Companies Register maintained by the Municipal Court in Prague, in Part C, File 132622, telephone number: +420 223 016 569, e-mail: info@cyklo69.cz (“Cyklo 69 s.r.o”), as the Seller of the Goods listed below and as a supplier of the Services listed below, specifies the conditions under which it is authorised (but not obligated) to provide Customers with the benefits associated with Customer Discounts (the definition of “Customer Discounts” is stated in Article II, Paragraph 2 of these Regulations).
  2. These Regulations shall apply to the purchase of both Goods and Services provided through the Cyklo 69 s.r.o. online shop (https://www.cyklo69.cz), or by telephone or electronic mail, in the purchase of Goods or Services at the place of business of Cyklo 69 s.r.o., at Jugoslávských Partyzánů 892/6, Prague 6 – Bubeneč, postal code: 160 00, place of business bearing the name “Specialized Concept Store” shop (“Place of Business”).
  3. Under the terms and conditions set out in these Regulations, Customer Discounts shall enable Customers, to receive discounts on the purchase of Goods and Services, to obtain receive offers on Goods and Services exclusively reserved for Customers, to make use of priority bicycle and electric bicycle servicing and to make use of other Services and benefits reserved exclusively for Customers. This provision shall apply without prejudice to the provisions of Article 1, Paragraph 1 of these Regulations, which states that it is a right but not an obligation of Cyklo 69 s.r.o. to provide a Customer with the benefits associated with Customer Discounts, i.e. Cyklo 69 s.r.o. may at any time Customer refuse to grant any customer the benefit associated with the Customer Discount.

II.
Definitions and Terms Used

  1. Express Service” shall mean that when servicing a bicycle, an electric bicycle or bicycle component, Cyklo 69 s.r.o. shall give priority to customers coming under any of the Customer Discount categories, including those listed below (see Article III, Paragraph 1 of these Regulations). Cyklo 69 s.r.o. shall also guarantee servicing within two days of the handover of the bicycle, electric bicycle or bicycle component for servicing (within 10 days if a service centre outside the Place of Business shall be required).
  2. Customer Discount“ shall mean benefits provided by Cyklo 69 s.r.o. to Customers.
  3. Priority Servicing” shall mean that when servicing a bicycle, electric bicycle or bicycle component, Cyklo 69 s.r.o. shall give priority to customers coming under any of the Customer Discount categories. Cyklo 69 s.r.o. also guarantees servicing within five days of the handover of the bicycle, electric bicycle or bicycle component (within 10 days if a service centre not on the Cyklo 69 s.r.o. premises shall be required).
  4. Service” shall mean Services supplied and delivered by Cyklo 69 s.r.o. in connection with conducting its business. This shall apply in particular to the servicing of bicycles, electric bicycles, the hire of bicycles and electric bicycles, and other Services, described in greater detail on the Cyklo 69 s.r.o. website (https://www.cyklo69.cz).
  5. Customer” shall mean a person included by Cyklo 69 s.r.o. in one of the Customer Discount categories.
  6. Goods“ shall mean goods supplied and delivered by Cyklo 69 s.r.o. in conducting its business. This shall apply in particular to bicycles, electric bicycles, bicycle frames, helmets, and bicycle protective gear, cycling clothing, tools, and other components, bicycle accessories and other goods, described in greater detail on the Cyklo 69 s.r.o. website (https://www.cyklo69.cz).

III.
Customer Discount Categories and entitlement to discounts

  1. Cyklo 69 s.r.o. offers the following categories of Customer Discounts (starting at the most basic category):
    1. Customer Discount Start,
    2. Customer Discount +,
    3. Customer Discount ++,,
    4. Customer Discount +++.
  2. Customer Discount Start
    1. To quality for this Customer Discount category, an initial spend of at least CZK 15,000 (including VAT) shall initially be required, or the purchase of one bicycle (excluding a children’s bicycle). This offer shall not apply to holders of an ISIC (International Student Identity Card), an ITIC (International Teacher Identity Card), a student record book, the holder of an EYCA (European Youth Card Association) card, the holder of a racing cyclist’s licence from the Czech Cyclists Association, in which the required spend is not reached.
    2. Under this Customer Discount category, the Customer may be offered:
      1. Priority Servicing,
      2. a 5% discount on the purchase price (including VAT) of Goods,
  3. Customer Discount +
    1. To qualify for this Customer Discount category, an initial spend of at least CZK 15,000 (including VAT) shall be required.
    2. Under this Customer Discount category, the Customer may be offered:
      1. Priority Servicing,
      2. a 7.5% discount on the purchase price (including VAT) of Goods,
  4. Customer Discount ++
    1. To quality for this Customer Discount category, an initial spend of at least CZK 100,000 (including VAT) shall be required.
    2. Under this Customer Discount category, the Customer may be offered:
      1. Express Servicing,
      2. the right within 30 days of signing an agreement to exchange purchased Goods for similar Goods (same type, category, brand, etc.), if such Goods are offered by Cyklo 69 s.r.o., or a refund of the purchase price of the Goods instead of returning it (“Exchange or Return of Goods”),
      3. a 10% discount on the purchase price (including VAT) of the Goods,
  5. Customer Discount +++
    1. Under this Customer Discount category, the Customer may be offered benefits individually agreed with Cyklo 69 s.r.o.
  6. Information about the Customer’s total spend is recorded at Cyklo 69 s.r.o., under the name, surname and fixed address of the Customer in the case of a natural person, or under the name (company name) and registered office of the Customer in the case of a legal entity or a natural person acting as a trader. Depending on the spend, the Customer is automatically included in a higher Customer Discount category. A sales voucher without the name of the Customer shall not be included in the Customer spend records. Sales vouchers must therefore be subject to inspection. Cyklo 69 s.r.o. shall bear no responsibility for the unauthorised use of third-party benefits.
  7. A discount on the purchase prices of Goods cannot include: used Goods, Goods for whose sale Cyklo 69 s.r.o. acts for third parties solely as an intermediary, Goods sold at a reduced price (discounted), as well as Goods that Cyklo 69 s.r.o. has thus indicated.
  8. A discount on the purchase price of Goods may be applied in combination with gift vouchers issued by Cyklo 69 s.r.o.
  9. The Exchange or Return of Goods (see Article III, Paragraph 4(b) of these Regulations) cannot be offered: for bicycles, electric bicycles, bicycle frames, used Goods, Goods for which Cyklo 69 s.r.o. acts for third parties solely as an intermediary, Goods sold at a reduced price (discounted), foodstuffs, special nutritional supplements and Goods that Cyklo 69 s.r.o. has thus marked. Furthermore, the Exchange or Return cannot be applied to Goods that the Customer has already used, or damaged, or Goods without the original packaging, or that cannot be repackaged, without the original labels and without the accessories that were handed over to the Customer.

IV.
Inclusion in Customer Discount Category

  1. A condition for qualifying for a Customer Discount category is, in addition to other conditions specified in these Regulations (see in particular the conditions specified in Article III of these Regulations and consists in achieving the minimum spend), submitting to Cyklo 69 s.r.o. complete and accurate personal information (and specifically for a natural person who is not a trader: name, surname, telephone number, home address; for a natural person who is a trader, or for a legal person: business name of the company and registered office). Cyklo 69 s.r.o. shall reserve the right not to include a person in the relevant category of the Customer Discount if the data is evidently incomplete or incorrect. The Customer, by providing the above information, confirms that it has familiarised itself with these Regulations, which form an inseparable part of the Conditions of Protection of Personal Data, which are used in matters concerning the protection and processing of personal data of the Customer by Cyklo 69 s.r.o. (https://www.cyklo69.cz/ochrana-osobnich-udaju/).
  2. Cyklo 69 s.r.o. shall subsequently store in its internal system the personal information submitted to it.
  3. Cyklo 69 s.r.o. reserves the right to unilaterally discontinue the offer of Customer Discounts (all or only certain categories). Upon termination of a Customer Discount, the right to enjoy (or partly use) the benefits associated with such a Customer Discount shall cease. A Customer included in a particular Customer Discount category unilaterally discontinued by Cyklo 69 s.r.o. shall not have the right to qualify for another such category.

V.
Benefits when purchasing Goods or when ordering the service of a bicycle, electric bicycle or bicycle component

  1. For a customer to obtain individual benefits when purchasing Goods or ordering the servicing of a bicycle, electric bicycles or bicycle component in the Place of Business, by telephone or electronic mail, the Customer is obligated to in a timely manner and without prompting, to inform Cyklo 60 s.r.o that it has been included in the relevant Customer Discount category.
  2. In the event that a purchase of the Goods or the ordering of the servicing of a bicycle, electric bicycle or bicycle component is made through the Cyklo 69 s.r.o. online shop (https://www.cyklo69.cz), he Customer must register on the website (i.e. it may not purchase or order as an “unregistered user” because in such a case a Customer cannot obtain the benefits associated with Customer Discounts). When Customer Discounts expire, the right to enjoy the (and partly use) benefits associated with them also expires. A Customer coming under the relevant Customer Discount category that Cyklo 69 s.r.o. has unilaterally terminated, shall not qualify for another Customer Discount category.

VI.
Joint and Final Provisions

  1. These Regulations are valid as they are shown on the Cyklo 69 s.r.o. website on the day of conclusion of a contract (for example, a purchase agreement, contract for services, and such like.) between Cyklo 69 s.r.o. and the Customer.
  2. Cyklo 69 s.r.o. reserves the right to amend or add to these Regulations without prior notice. The current version of these valid Regulations is available in electronic format on the Cyklo 69 s.r.o. website (https://www.cyklo69.cz/zakaznicke-slevy/) and they can be archived or copied.
  3. With regard to the protection and processing of personal data of the Customer by Cyklo 69 s.r.o., the Regulations on Personal Data Protection, which are located on the Cyklo 69 s.r.o. website (https://www.cyklo69.cz/ochrana-osobnich-udaju/) shall apply.
  4. Any divergent arrangement in a specific agreement between the Customer and Cyklo 69 s.r.o. (for example, a purchase agreement, contract for services, and such like) shall have priority over these Regulations.
  5. These Regulations shall come into force on 1 November 2018.
